Child custody, physical care, visitation and support are issues that arise in both divorces where there are children involved as well as when a child is born out of wedlock. "Child Custody" refers, generally, to a parent's right to be involved in major decisions impacting their child's welfare. Except in rare circumstances, a court will award joint legal custody to parents of a minor child. Once joint custody is ordered, a court will determine which parent should have "physical care" of the child, or whether the parties shall have "joint physical care", which refers to a situation in which each parent has the child in his or her care roughly 50% of the time. Child support is ordered based on the physical care arrangement and the child support guidelines, which are issued by the Supreme Court of Iowa pursuant to Iowa statutory law.
